We recently won an appeal against the RPA which resulted in back payments being made to our client in the region of £25,000!
This was a client new to us in 2018 and it was when going through their paperwork for the first time that the mistakes, dating back to 2005, became apparent. The client had no idea they had been underpaid, not just once, but every year from 2005 until now.
The case was complicated and contained several separate issues, but the appeal focused on one error by the client and another by the RPA. It was possible to prove the error made by our client was an ‘obvious’ one and in such cases the RPA is obliged to correct the error and reprocess the claim. In addition, the RPA had made mistakes processing the claim which we also successfully appealed.
It took almost a year to get the result and involved a lot of rummaging through old paperwork (and attics!) but it was definitely worth it in the end.
